General Terms and Conditions (GTC) of Silkus Silk

1. Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses through our online shop at silkus-silk.com.

(2) Consumers within the meaning of these GTC are natural persons who enter into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activities.

(3) Businesses within the meaning of these GTC are natural or legal persons or partnerships with legal capacity who act in the course of their commercial or self-employed professional activity when entering into a legal transaction.

2. Contract Partner, Conclusion of Contract

(1) The purchase contract is concluded with Silkus Silk, represented by silkus-silk.com.

(2) The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to order. By clicking the "Buy Now" button, the customer submits a binding offer. Acceptance of the offer occurs by sending an order confirmation via email or by shipping the goods.

(3) If an item is unavailable, we will notify the customer promptly and refund any payments already made.

3. Prices and Shipping Costs

(1) All prices are stated in the local currency and include the applicable taxes.

(2) Shipping costs are calculated separately and displayed during checkout.

(3) For deliveries to countries outside the local region, additional customs duties, taxes, or fees may apply, which are the responsibility of the customer.

4. Payment Terms

(1) Payment can be made by prepayment, PayPal, credit card, or other payment methods offered in the shop.

(2) The purchase price is due immediately upon conclusion of the contract.

(3) If the customer defaults on payment, statutory regulations regarding default interest will apply.

5. Delivery and Retention of Title

(1) Delivery will be made to the address provided by the customer.

(2) Unless otherwise stated, the delivery time is typically 5–14 business days after receipt of payment.

(3) The goods remain our property until full payment is received.

6. Right of Withdrawal

(1) Consumers have a statutory right of withdrawal of 14 days without providing any reasons.

(2) The period begins on the day the customer or a third party designated by them receives the goods.

(3) To exercise the right of withdrawal, the customer must inform us via email or post and return the goods within 14 days.

(4) Return shipping costs are borne by the customer unless the goods were faulty.

7. Warranty and Liability

(1) Statutory warranty rights apply.

(2) In case of defects, the customer is entitled to demand a remedy (repair or replacement).

(3) We are not liable for damages caused by improper use or normal wear and tear.

(4) For slight negligence, we are only liable in the case of violation of essential contractual obligations.

9. Dispute Resolution and Jurisdiction

(3) The laws of the jurisdiction in which Silkus Silk is registered apply. The place of jurisdiction, where permissible, is our business location.

(1) Changes or additions to these GTC must be made in writing.

(2) Should any provision of these GTC be found to be invalid, the validity of the remaining provisions will remain unaffected.
